1. Agreement to Terms

By creating an account or using BaseCount, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the application. These terms constitute a legally binding agreement between you and BaseCount.

2. Description of Service

BaseCount provides AI-powered cheerleading analysis, including:

• Video processing and frame-by-frame analysis of cheerleading routines
• Private storage of the routines you upload, so you and the people you link can watch them back on any device, for the retention period of your plan
• AI-generated performance scoring and skill assessments
• Personalized coaching recommendations and feedback
• Team management and athlete tracking tools

3. User Accounts

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your password and account
• One account per person; shared accounts are not permitted
• You are responsible for all activity that occurs under your account

4. Age Requirements & Parental Consent

• Users under 13 years of age require verifiable parental consent to use BaseCount. At sign-up we collect a parent or guardian's email and send them a confirmation link; until they confirm, the account cannot analyze videos or use the coach chat
• Users between 13 and 17 may use the app with parental awareness and oversight
• Parents and guardians are responsible for their child's use of the service and any data submitted on their behalf, including deciding whether the child's videos are stored in the account and whether face recognition is consented to for them

5. Acceptable Use

When using BaseCount, you agree to the following:

• Only upload videos that you have the right to share and analyze
• Do not upload videos of individuals without their knowledge or consent
• Do not upload illegal, harmful, or inappropriate content. Videos showing nudity or sexual content are refused automatically and are not analysed; each refusal is recorded against the account and reported to us, and uploading such content may lead to your account being removed
• Do not attempt to circumvent consent checks or other privacy protection features
• Do not reverse-engineer, decompile, or otherwise attempt to extract the source code of the application

6. Video Content

• You retain ownership of all video content you upload
• On the paid plans your uploaded routines are stored privately in your account, on our video hosting provider, for the retention period of your plan (30 days Individual, 90 days Gym), and deleted at the end of it or when you delete the routine. The Free plan does not store video
• We process videos solely to provide the service: storing and transcoding them for playback, and sending still frames from them to our AI service for scoring
• Still frames from your uploads are sent to a third-party AI service (Google Gemini) for scoring, and up to one minute of their audio (no pictures) to transcribe the announcer. Faces in the frames are not blurred
• Before each upload you confirm that you have permission from the people in the video — and, for anyone under 18, from their parent or guardian — to upload it and have it analysed. You are responsible for that permission being true. We keep a record of each confirmation
• By uploading content, you grant us a limited, revocable license to store, transcode and process it for service delivery, and to show it to the people you link to your household. That license ends when the video is deleted
• Do not upload footage of people who have not agreed to be filmed, and do not upload footage you do not have the right to share

7. Subscriptions & Payments

• A Free tier is available with limited analysis features
• Paid tiers (Individual and Gym) are billed monthly or seasonally
• New accounts start with a free trial of the paid features. No card is required to start it, and nothing is charged unless you choose a plan afterwards
• You can cancel or change your plan at any time from Settings → Manage billing / cancel, which opens our Stripe-hosted billing portal. Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• Payments are processed securely through Stripe

8. Intellectual Property

The analysis, scores, and coaching content generated by our AI are provided for your personal use only. You may not redistribute, resell, or commercially exploit AI-generated content without written permission. The BaseCount name, logo, and branding are our intellectual property and may not be used without authorization.

9. Limitation of Liability

• AI analysis is provided for educational and coaching purposes only
• BaseCount does not supervise, observe, or control any physical activity. It is software that reviews recorded video after the fact. It is not a substitute for a qualified coach, a trained spotter, or in-person safety supervision, and nothing in the app should be read as clearance to attempt a stunt, tumbling pass, or any other skill
• BaseCount is not a substitute for professional coaching or medical advice
• We are not liable for injuries that may occur during practice or performance
• Scores and assessments are AI-generated estimates and should be used as guidance, not absolute measures
• We provide the service "as is" without warranties of any kind

10. Data & Privacy

Your use of BaseCount is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the service, you consent to the data practices described in our Privacy Policy.

11. Termination

• We may suspend or terminate accounts that violate these Terms of Service
• You may delete your account at any time through the app (Settings → Delete My Account) or by contacting support, and download a copy of your data first (Settings → Download my data)
• Upon deletion or termination, your content and personal data are deleted as described in our Privacy Policy; payment and order records required by law are retained without a link to your account

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to users via email and in-app notification. Your continued use of the app after changes are posted constitutes acceptance of the revised terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
